Proposition 8 is dead.
Following today’s finding that the Defense of Marriage Act is unconstitutional, the Supreme Court has now declared it will not hear appeals against California’s decision to strike down Prop 8.
This means that same-sex couples in California will remain legally married, entitled to the legal benefits federal government affords all married couples.
Dave, your last comments are off. The validity of same-gender marriages entered into before the passage of Prop 8 was already decided by the California Supreme Court to be proactive and not retroactive. The validity of those marriages were never in dispute in Hollingsworth v. Perry, the issue was the right to marry/what happens when a right so fundamental as marriage rights are taken away.
